Mediation is a dynamic, structured, interactive process where a neutral third party (your mediator) assists disputing parties in resolving conflicts. All participants in mediation are encouraged to actively participate in the process to ensure the best possible outcomes. Mediation is a "party-centered" process in that it is focused primarily upon the needs, rights, and interests of the parties. The mediator uses a wide variety of techniques to guide the process in a constructive direction and to help the parties find their optimal solution. A mediator is the facilitator of the process.

I am often asked why someone would use a mediator rather than a lawyer. My answer is simple; a mediator is open to whatever outcome satisfies both parties, where a lawyer can have an agenda and fights for one side. I always recommend that clients seek legal advice and I love working with lawyers on sticking points, but not all couples need to. Mediation also offers an environment of collaboration that tends to create a faster, more cost effective result.
STEP 1) We start with a free consultation. Simply an opportunity to ask questions and lay the groundwork.
STEP 2) Should you decide to proceed, we then enter into an Agreement to Mediate. This is our commitment to work together through this process. At this stage we gather information and identify items to be discussed.
STEP 3) The Mediation. This is where we sit together and work out the nitty gritty. This can often be accomplished in 1-3 sessions but will take as long as it needs to get all topics addressed.
STEP 4) The Memorandum of Mediation. Once we have worked out the details, you will receive a Memorandum of Mediation outlining each item discussed. This is your contract. It can be taken to your attorney to become legally binding but often clients find this to be an unnecessary expense.
STEP 5) The follow-up. Though this is not required, it is encouraged that clients predetermine a follow up meeting to make any adjustments to the agreement that they see necessary. 3 months, 6 months, and 1 year are all popular adjustment points.
Part of what a good Mediator does is recognizes when an expert is required. This can sometimes mean we are calling upon an accountant, a lawyer, a counsellor, a realtor, or any number of other experts in their fields. This is often given as "homework" when a topic requires more information.
